竞争法具有双重价值,一是通过制止不正当竞争行为,使经营者之间的竞争关系维持在合法范围内,二是保护消费者的合法权益,使之享受竞争产生的福利。有学者认为竞争法规范经营者竞争行为的终极目的是为维护消费者利益,这从某种程度上说明经营者的竞争对消费者权益会产生极大影响,而竞争法的主要作用就是对经营者竞争行为加以矫正。本文以中国移动与中国联通的竞争关系为例,分析经营者竞争对消费者的影响,以及社会规范如何对其进行矫正。
The competition law has the dual value. First, by preventing unfair competition, the competition among operators is maintained within the legal scope. The second is to protect the legitimate rights and interests of consumers so that they can enjoy the benefits of competition. Some scholars think that the ultimate purpose of the competition law norms of operators is to safeguard the interests of consumers, which to some extent shows that the operator’s competition will have a great impact on consumer rights, and the main role of competition law is to operate The competitive behavior to be corrected. This article takes the competition between China Mobile and China Unicom as an example to analyze the impact of business competition on consumers and how social norms can correct them.
