《劳动合同法》施行八年以来,学术界、实务界对其运行效果的评价褒贬不一,不少条款商榷余地甚大。其中,该法第4条第2款对“劳动纪律”的规定、第39条第2款对“严重违反用人单位的规章制度”的规定,无论在立法解释上还是在实务操作上,都存在不少问题,实有探讨之必要。为此,本人试图从立法权、制定权、司法权角度,就劳动者旷工涉及的相关问题进行分析,并提出了自己的看法。
Since the implementation of the Labor Contract Law for eight years, academics and practitioners have mixed opinions on the operational effects of the Labor Contract Law. Many articles have a lot of room for negotiation. Among them, the provisions of Article 4, paragraph 2, of the Law on the “Labor Discipline” and Article 39, paragraph 2, on the “serious violation of the rules and regulations of the employer”, whether in legislative interpretation or in practice There are many problems that exist in the discussion. For this reason, I try to analyze the relevant issues involved in absenteeism of workers from the perspective of legislative power, formulation power and judicial power and put forward my own views.
