城市住宅建设用地使用权的续期问题成为当下法学中的热点,由于《物权法》第149条仅对建设用地使用权续期问题进行了概括性规定,实践中的理解与适用需要依赖于法律解释。以70年住宅建设用地使用权为例,把“自动续期”理解为无偿、无须再次申请、续期无次数限制以及续期后房屋转让的无限制等。自动续期后的住宅建设用地使用权在权利性质上仍然是用益物权,其母权是城市土地的民法上国家所有权。自动续期后的住宅建设用地使用权无论与城市土地的民法上国家所有权还是宪法上国家所有权均无冲突且完全协调。由于建设用地使用权续期关涉公民的基本财产权利,因此需由全国人民代表大会或常委会通过立法予以规制。
The renewal of the right to use urban residential construction land has become a hot spot in current jurisprudence. As Article 149 of the Real Right Law only provides general provisions on the renewal of the right to use construction land, the understanding and application in practice depend on the legal interpretation . Take the 70-year right to use land for residential construction as an example, the term “auto-renewal” is to be understood as being unpaid, there is no need to apply again, the number of renewals is unlimited, and there are no restrictions on the transfer of houses after the renewal. The right to use land for residential construction after the automatic renewal is still usufruct in the nature of rights, and its mother power is the state ownership of civil land in urban land. The right to use the land for residential construction after the auto-renewal has no conflict with and completely coordinated with the state ownership of the civil land in the urban land or the constitutional state. As the renewal of the right to use construction land is related to the basic property rights of citizens, it must be governed by the National People’s Congress or the Standing Committee through legislation.
