《最高人民法院关于审理劳动争议案件适用法律若干问题的解释(二)》于2006年7月10日最高人民法院审判委员会第1393次会议通过,将于2006年10月1日起施行。该文件第三条规定:“劳动者以用人单位的工资欠条为证据直接向人民法院起诉,诉讼请求不涉及劳动关系其他争议的,视为拖欠劳动报酬争议,按照普通民事纠纷受理。”该项制度的制定,引起了社会各界的广泛讨论,各界人士拍手称快。然而,在欣喜的同时,也有伤感,也有对农民工讨薪中出现的新问题的担忧……
The Supreme People’s Court’s Interpretation on Several Issues Concerning the Application of Law in the Trial of Labor Dispute Cases (II) was approved by the 1393rd meeting of the Supreme People’s Court Judgment Committee on July 10, 2006 and will come into effect on October 1, 2006. Article 3 of this document stipulates that: “If a worker files a suit directly with the people’s court on the evidence of a wage bill of the employing unit and the claim does not involve other disputes concerning labor relations, it shall be treated as a dispute over labor remuneration and is accepted as ordinary civil dispute.” The formulation of the system has aroused extensive discussions from all walks of life and people from all walks of life clap their hands fast.
