古典学派关于教唆犯共犯从属性地位的结论,值得质疑。对相关理论的追溯及古典学派语境下教唆犯构成要件的解构表明,教唆者与被教唆者之间并不具有必然的共犯关系。同时,教唆犯的共犯性地位将直接导致被教唆者未着手实施犯罪、实施的是非所教唆犯罪等情况下犯罪认定及刑罚裁量上的牵强。认定教唆犯为具有构成性地位的独立犯,既是对古典学派共犯论体系的重构,也是一种完善。
