科斯教授在《联邦通讯委员会》一文中明确宣示:产权界定是非常重要的,界定后的市场自由转让会自发地导向资源的有效配置。然而市场自由转让依然可能面临着交易成本过高的困难,所以在产权初始界定的阶段就要考虑到这个问题。有关产权界定的最基本法律是物权法,作为物权法的基本原则之一的物权法定原则致力于保证物权的可转让性,强制标准化和反公地悲剧两种理论从不同的侧面可以解释这一点,并在解释过程中透视出物权法定的经济内涵。
