法学教育的实践转型,作为中国法学教育的发展方向,具有促动法学教育改革、提升中国法治文化、贡献世界法律文明的重要意义。现代中国的职业导向型法学教育存在着理论与实践脱节的问题。要真正达到法学教育植根于实践、着眼于实践、服务于实践这一目标,应当明确法律人才应具备的学习能力、思维能力与表达能力,应致力于形成基于实践、关心实践、服务实践的理论观,应着眼于法学教学内容与方法的实践转型,并在借鉴国外经验的基础上推陈出新,锐意独创。在法学教育的过程中,要注重知识,更要注重能力;要注重理论,更要注重实践;要注重素质,更要注重伦理。法律人才培养的成功,外部激励只能起部分作用,核心因素仍是教育者的敬业精神。
