近年来,硫酸泼熊,活猴取脑,以及随处可见的虐待流浪猫、流浪狗的事件频发,引发了社会各界人士的愤怒与怜悯之情。一直以来,我们都是将动物作为一种客体,用一些动物保护法等法律,从公法的角度来对动物进行总体概括的保护,但是虐待动物之风仍屡禁不止。于是,很多学者提出了将动物作为权利主体,来赋予其相应权利以保护动物的观点,这种方式是否科学,能否实现,笔者拟从这些社会现实出发,从人格的演变过程,自然法与实在法的角度等方面来对动物权利理论的可能性进行相应的梳理与分析,最后得出结论:用赋予动物权利的方式等同于更好的保护动物在理论上是行不通的,我们应该将动物作为一种特殊的客体抑或更好的办法来对动物加以保护。
In recent years, splashed bears of sulfuric acid, living monkeys taking their brain, and the widespread abuse of stray cats and stray dogs have aroused the anger and compassion of all walks of life. From these social realities, I intend to proceed from the evolution of personality, natural law and From the point of view of the law and so on, the thesis analyzes and combs the possibility of the theory of animal rights, and finally concludes that it is theoretically impossible to equate the better protection of animals by means of conferring the right of animals.
