在当今中国,法律需要现代化,这是一个不争的事实。然而围绕着法制现代化之路径问题却是一个颇为争议,颇多敏感的话题。长期以来,有人倡导通过法律移植来实现中国法制现代化,有人力主利用本土资源来成就现代化。一方面,从全球角度来看,法制现代化历史运动是从西方起步的,现代化所要求的社会条件在我国又缺乏本土化资源。在全球化浪潮的席卷下,“法律移植论”似乎成了一个唯一的选择,但另一方面,现代化不等于西方化,法律必须体现文化的相对性,从中国法制实践来看,缺乏本土文化的移植也并不成功。更有甚者,盲目的法律移植还有可能使我们的法律发展处于依附西方法律文化的处境。鉴于此,作者提出,移植和本土化并不矛盾。在当今中国,要将“法律移植”与“本土化”结合起来。将移植过来的东西本土化,在本土资源之上注入西方先进的法律养分。这才是中国法制现代化最合理的路径选择。
In today’s China, the law needs modernization. This is an indisputable fact. However, the issue of the path of modernization of the legal system is a rather controversial and sensitive one. For a long time, some people advocated the legal transplants to realize the modernization of China’s legal system and some made major efforts to use local resources to achieve modernization. On the one hand, from a global point of view, the historical movement of modernization of the legal system started from the West. The social conditions required by the modernization in our country lack the resources of localization. Under the wave of globalization, the theory of legal transplantation seems to be the only option. On the other hand, modernization does not mean Westernization. The law must reflect the relativity of culture. From the point of legal practice in China, the lack of local culture The transplant also did not succeed. What is more, blind legal transplantation may also make our legal development dependent on Western legal culture. In view of this, the author proposes that transplantation and localization are not contradictory. In today’s China, “legal transplantation” and “localization” should be combined. To localize the transplanted things and inject advanced Western legal nutrients into the local resources. This is the most reasonable path to the modernization of China’s legal system.
