诉愿权是宪法基本权利体系中不可或缺的要素,为保护公民合法权益,防止国家侵犯公民合法权益,许多国家明确规定了诉愿权。本文试就公民诉愿权在我国宪法文本中的相关规定展开论述,初探我国宪法基本权利的救济权利理论研究和制度完善。
The petition is an indispensable element in the basic rights system of the Constitution. Many countries have clearly stipulated the right of petition in order to protect the legitimate rights and interests of citizens and prevent the state from infringing the legitimate rights and interests of citizens. This article tries to discuss the relevant provisions of citizen’s petitions in the constitutional texts of our country, and probes into the theoretical research and system improvement of the remedy rights of the constitutional fundamental rights in our country.
