联合国安理会在2008年连续通过四个决议,授权各国在索马里过渡政府同意的情况下,使用一切必要手段打击索马里海盗。但由于联合国集体安全机制的本质性缺陷以及相关国际法的滞后,此次授权使用武力对联合国集体安全机制形成冲击。本文旨在探讨打击索马里海盗给国际法带来的冲击及其原因,并提出完善打击海盗的国际法的若干思考。
The UN Security Council passed four successive resolutions in 2008, which empowered all countries to use all necessary means to combat Somali pirates with the consent of the Somali transitional government. However, due to the inherent deficiencies in the UN collective security mechanism and the lag in relevant international laws, the current authorization to use force has an impact on the UN collective security mechanism. The purpose of this article is to explore the impact of Somali piracy on international law and its causes, and to put forward some thoughts on how to perfect the international law against piracy.
