从拉萨“3.14”事件看,构建刑事被害人救助制度是维护西藏和谐稳定的需要。目前,尽管建立全国性的刑事被害人救助制度的时机尚不成熟,但是,可从各地方试点做起,积极探索和积累刑事被害人政府救助的立法经验。西藏地方应当坚持从实际出发和量力而行原则,先实行政府救助,后推行政府补偿,并借鉴宁夏地方刑事被害人救助的做法,主要明确救助对象与范围、落实救助资金、严格救助审批程序。
From the Lhasa “3.14 ” incident, it is necessary to build a system of assistance to victims of the criminal to safeguard Tibet’s harmony and stability. At present, although it is immature to set up a nationwide system of assistance to criminal victims, we can start from the local pilot programs and actively explore and accumulate the legislative experience that the victims victims government aid. Tibet should adhere to the principle of proceeding from reality and starting from one’s own will, implementing government aid first, then implementing government compensation, and drawing lessons from the assistance of local criminal victims in Ningxia. The main objectives are to clarify the targets and scope of aid and to implement the bailout fund and strictly aid the examination and approval process.
