南非是非洲经济强国之一,资源丰富,政治稳定,经济和法制等方面条件比较完善,是中国对非贸易第二大伙伴。随着中国与南非经贸投资、劳动合作关系日益密切,中国在南非投资建立的工厂和企业也日益增多。根据南非的劳动法律,中资企业的雇员必须主要来源于南非。在劳动雇佣中,由于不了解南非劳动立法和司法实践,导致大量劳动争议。及时有效地解决劳动争议,可以避免我国企业的重大经济损失。此外,南非劳动争议处理机制中,形式多样的劳动争议处理方式,严格的争议处理程序和先进的劳动司法制度可以为我国劳动争议处理机制的建设提供参考和借鉴,同时,也可以为我国对南非投资的企业提供劳动争议解决方面的实践指导。
