各国议会是否应当参与以及如何参与联合国人权理事会普遍定期审议机制正在成为这一机制创立以来的一个新话题。从议会在人权保护和促进方面固有的独特优势、人权条约机构的实践、有关普遍定期审议的国际法文件来看,各国议会应当、而且可以参与这一机制。从实践来看,一些国家的议会已经在国家报告的准备、互动对话、审议建议的执行等各个阶段参与这一机制。其他国家议会的这些相关做法,对我国具有一定的参考和借鉴意义。我国的全国人大常委会在国家报告的准备、互动对话和审议建议中已经参与这一机制,但是在一些领域作用还有待加强。
Whether the parliaments should participate and how to participate in the universal periodic review mechanism of the UN Human Rights Council is becoming a new topic since the founding of this mechanism. From the unique parliamentary advantages inherent in the protection and promotion of human rights, the practice of human rights treaty bodies and the documents of international law relating to the universal periodic review, parliaments in various countries should, and can participate, in this mechanism. From a practical point of view, the parliaments of some countries have participated in this mechanism in all stages of preparations for the national report, interactive dialogue and the implementation of the recommendations. These related practices of other national parliaments have some reference and reference significance to our country. Our NPC Standing Committee has already participated in this mechanism in the preparations for the national report, the interactive dialogue and the proposal for consideration, but its role in some areas needs to be further strengthened.
