政府信息公开工作中的可分割性原则,是针对例外信息豁免公开而设置的一项专门规定,旨在保障公民的知情权和信息获取权,更加充分而有效地监督政府。这一原则适用政府信息中所含有的国家秘密、商业秘密、个人隐私和其他敏感信息等例外信息。政府需要把握好操作这一原则的关键:原涉密信息的继续保护,信息分割的能够区分处理,结果告知信息公开申请人并说明理由等。
The principle of divisibility in the government information disclosure work is a special provision for the exemption from disclosure of exception information. It aims at safeguarding citizens’ right to information and access to information and supervising the government more fully and effectively. This principle applies exceptions such as state secrets, trade secrets, personal privacy and other sensitive information contained in government information. The government needs to grasp the key to the principle of operation: the continuous protection of the original confidential information, the division of information can be distinguished from each other, and the applicant can be informed of the result of the information disclosure as well as the reasons.
