【要点提示】雇主对雇员在从事雇佣活动中受到身体损害的赔偿,不以雇佣关系的有效性和雇佣活动的合法性为前提,雇员的身体损害即使发生在非法雇佣活动中,雇主仍应承担责任。未成年人的身心健康受到国家法律的特殊保护,不因其过错而丧失对人身损害的救济权利。
[Points to note] Employers compensate employees for physical injuries in employment activities, not on the validity of the employment relationship and the legitimacy of employment activities, even if the employee’s physical damage occurs in the illegal employment activities, the employer should still bear responsibility. The physical and mental health of minors is specially protected by the laws of the country and no one is deprived of the right to relief against personal injury because of his fault.
