2012年5月,我参加了第二十五期中法公证法律专家专题讲座。在聆听法国同行介绍法国公证体系的过程中,一个概念的提出引起了我的强烈兴趣,那就是法国公证人所特有的职业义务——咨询义务。据法国同行介绍,法国公证人特有的职业义务主要有两项:第一项是公证义务,包含效率义务;第二项即咨询义务,咨询义务作为公证义务的必要补充,也可以称为是效率义务的一个积极组成部分。其实质是法律性的,是一种涵盖广泛的义务。公证人负有向自己的所有客户提供咨询的义务。针对客户所面临的问题,公证人首先的咨询义务是指出能够解决问题的法律手段并必须告知法律允许和法律禁止的事项。当然,如果公证人发现客户希望办理的公证事项触犯到法
In May 2012, I participated in the twenty-fifth issue of notary legal experts from China and France.
