(1993年12月18日上海市人民政府批准) 第一条 为了维护本市劳动力市场管理秩序,加强对单位使用、聘用外地劳动力的管理,根据本市实际情况,制定本规定。 第二条 本市行政区域内的国家机关、社会团体、企业、事业单位、部队所属单位和个体工商户(以下统称单位)使用、聘用外地劳动力的,必须遵守本规定。 前款所称外地劳动力,是指年满18周岁、具有初中以上文化程度、身体健康、在本市务工且不具备本市常住户口的人员。 第三条 市劳动局是本市单位使用、聘用外地劳动力的行政主管部门。各级政府有关职能部门应按各自职责,做好单位使用、聘用外地劳动力的管理工作。
(Approved by the Shanghai Municipal People’s Government on December 18, 1993) Article 1 These Provisions are formulated in accordance with the actual conditions of the Municipality in order to maintain the order of labor market management in the municipality and to strengthen the management of employing and employing foreign labor forces. Article 2 The State organs, social groups, enterprises, public institutions, units affiliated with the armed forces and individual industrial and commercial households (hereinafter collectively referred to as the “units”) within the administrative area of this Municipality must abide by these Provisions in employing and employing foreign labor forces. The term “foreign labor force” as mentioned in the preceding paragraph refers to those who have attained the age of 18 and have a junior high school education or above, are in good health, and are employed in the municipality and do not have permanent residence in the municipality. Article 3 The Municipal Labor Bureau is the administrative department in the city that employs and employs foreign labor. Relevant functional departments at all levels of government shall, according to their respective functions and duties, do a good job in employing and hiring labor management in the field.
