起诉与受理是行政诉讼程序的起始阶段。起诉是启动司法审查程序的前提条件 ,与其他诉讼程序一样 ,行政诉讼遵循不告不理原则 ,只有在行政相对人起诉后 ,才可能引起司法权对行政权的监督。受理是为防止相对人滥用诉权任意起诉而设置的审查程序 ,通过审查相对人的起诉 ,人民法院 Prosecution and admissibility are the initial stages of administrative proceedings. Prosecution is the prerequisite for launching the judicial review process. Like other legal proceedings, administrative litigation follows the principle of impartiality. Only when the administrative counterpart files a lawsuit can it cause the judicial power to monitor the executive power.
