随着大中城市经济建设的快速发展、人民生活水平的不断提高,城市中的汽车数量连年累增,交通堵塞成了各个城市的首要难题。随之,打车软件应运而生,其在一定程度上缓解了人们出行难的尴尬局面。与此同时,为更高效的发展这种新打车模式,“拼车”的热潮也正向大众袭来。它通过资源共享,减少车辆空驶率,缓解了交通拥堵的压力,节约了能源,增加了出行方式的选择,人们生活也更加经济方便。在其带来诸多益处的同时也存在一些问题,本文从引人关注的“不来梅拼车”成功案例切入;首先对都市“拼车”现象进行简要的介绍;再例举我国现阶段中“拼车”现象所存在的问题和风险;最后提出对以上问题的法律思考和解决建议。
With the rapid economic development in large and medium-sized cities, the continuous improvement of people’s living standards and the increasing number of cars in cities, traffic congestion has become the primary challenge in all cities. Subsequently, the taxi software came into being, which to some extent eased the embarrassing situation of people traveling difficult. In the meantime, the “carpool” boom is also coming to the public for a more efficient development of this new taxi model. Through resource sharing, reducing vehicle empty rate, easing the pressure of traffic congestion, saving energy, increasing the choice of mode of travel, people’s lives are more economical and convenient. In the meantime, there are also some problems brought by it. This article starts from the successful case of “Bremerhaven carpool”; first, it briefly introduces the phenomenon of “carpooling” in the city; “Carpool ” phenomenon of the existing problems and risks; finally proposed legal thinking on these issues and solutions to the proposal.
