随着我国社会经济的快速发展,尤其是沿海经济发达地区,大量的人口流动在给当地经济带来繁荣景象的同时,也给当地的社会治安造成了许多不稳定的因素,流动人口犯罪较为突出。当地公安检察机关在处理这些案件的时候,首要面对的是犯罪嫌疑人的真实身份问题。但由于流动人口的复杂性和制度上的缺失,往往使犯罪嫌疑人的真实身份难以确定,这就需要犯罪嫌疑人自报身份。但自报身份正确与否对之后公安检察机关的刑事侦查和追诉工作能否顺利展开有着重要的影响。可见,认定犯罪嫌疑人的真实身份不仅关系到侦查工作的正常运作,也关系到一个地区乃至社会的稳定。本文试着从刑事案件中犯罪嫌疑人自报身份的总体情况、产生的原因、具体的表现以及应对的对策等角度对自报身份问题进行简要的探讨。 With the rapid socio-economic development of our country, especially in economically developed coastal areas, a large number of population flows have brought prosperity to the local economy. At the same time, many unstable factors have also been caused to local social order and the crime of floating population has become more prominent . When dealing with these cases, the local public security procuratorial organs mainly face the issue of the true identity of the criminal suspects. However, due to the complexity of the floating population and the lack of system, it is often difficult to determine the true identity of the suspect, which requires the suspect’s self-reported identity. However, whether the self-reported identity is correct or not will have a significant impact on the success of the criminal investigation and prosecution work of the procuratorial organs afterwards. It can be seen that the true identity of the criminal suspect is not only related to the normal operation of the investigation work, but also to the stability of one region and even the society. This article tries to make a brief discussion on the issue of self-reported identity from the perspective of the overall situation of the criminal suspects’ self-reported identities, the causes of their occurrence, the specific performance and the countermeasures against them.
