2015年“双十一”网络购物狂欢节结束后,淘宝网公布了仅仅一天的总销售额为1229.4亿,比2014年增长了52.7%,突破以往记录,再次刷新历史最高。此消息公布后顿时引起了全民的关注。网络购物因其成本低、速度快、购物方便等优势逐渐成为一种最重要的消费方式。随着网络及智能手机的普及未成年人网购的例子也日益增多,但在网络环境下,买卖双方并非跟传统买卖合同一样面对面磋商,而是通过计算机、手机等通讯设备来订立合同,由于网络的虚拟性,使卖家无法充分了解买家是否是适格的合同订立对象,也无法对其进行实质审查,因而出现了许多合同无效而使卖家遭受损失的实例,引发了很多网络交易纠纷。网络的虚拟性对未成年人缔约能力的认定产生必然冲击,同时会影响未成年人网络购物合同效力的认定。

Of the virtual nature of the seller so that the seller can not fully understand whether the contract is a proper object of the contract, it can not be substantive examination of it, resulting in many contracts invalid and the seller suffered a loss example, triggered a lot of online trading disputes. The virtual nature of the network has the necessary impact on the identification of the contracting power of minors and at the same time it will affect the determination of the validity of minors’ online shopping contracts.
