“国酒茅台”商标申请例是否应予以注册的核心争议点在于该标志是否符合“具有欺骗性”和“具有其他不良影响”的因合法性不予注册事由,在之前的我国司法实践中往往以此两种理由拒绝注册。但比较美国对于欺骗性的认定标准及步骤可知,美国对于欺骗性的认定需依次经过三个步骤,且以显著性判断为先导,对于“国”字头商标也主要采用仅具描述性的因显著性不予注册理由,这有利于保护申请人既存利益、激发商誉积累积极性。本文由一般到特殊,在探讨中美欺骗性标志认定标准与步骤基础上,研究两国“国”字头商标的审查规则以及具体到“国酒茅台”申请例的获注册可能性,探究异同,有益借鉴。
