随着社会主义市场经济的迅速发展,企业这一独立法人实体也已经逐步参与到激烈的市场竞争中来。良性的劳动关系甚至可以说是一个企业得以生存和发展的坚强后盾。本文就以劳动合同的解除概述为突破口,详细阐述现行法律中对劳动合同解除的规定及其不足之处。最后,针对完善劳动合同解除制度提出合理的建议。
With the rapid development of the socialist market economy, the independent legal entity as an enterprise has also gradually taken part in the fierce market competition. A benign labor relationship can even be said to be a strong backing for the survival and development of an enterprise. In this paper, the dismissal of the labor contract as a breakthrough point, detailing the current law on the termination of the labor contract and its inadequacies. Finally, we put forward reasonable suggestions for improving the labor contract cancellation system.
