1971年设立国际油污损害赔偿基金公约(简称71年基金公约)自1971年12月18日制订以来,迄今已十四年有余。它于1978年10月16日生效,至今也有七年多了。71年基金公约为什么能得到许多国家,特别是一些石油进口大国(如日本)的支持?它在保护缔约国的海洋环境方面起了什么作用?油污基金怎样向油污受害人提供足够的赔偿?油污基金与油轮船东和石油公司自愿赔偿协定有何区别?其前景如何?我国是否应加入71年基金公约?本文试图对71年基金公约及其所设立的国际油污赔偿基金(简称油污基金)进
The 1971 Convention Establishing the International Fund for Oil Pollution Damage (hereinafter referred to as the “71 Fund Convention”) has been more than 14 years since it was enacted on December 18, 1971. It came into force on October 16, 1978 and has been more than seven years. Why did the 71-year fund convention get the support of many countries, especially some big oil-importing countries such as Japan, and what role does it play in protecting the maritime environment in the State party? How can the oil-contaminated fund provide adequate compensation to oil-polluter victims? What is the difference with the agreement of voluntary reparations of oil tankers and oil companies and their prospects? Should China join the 71-year fund convention? This article attempts to review the 71-year fund convention and the International Oil Pollution Compensation Fund
