2014年北京APEC会议上我国计划在2030年设定碳排放总量最大限值,为此我国将逐步扩大碳交易市场版图,进行跨区域碳交易。然而由于全国性碳交易立法缺失和地方性立法差异性较大,导致跨区域碳交易市场处于无序状态。在借鉴欧盟、美国较为成熟的区域性碳排放权交易立法的基础上,通过构建跨区域碳排放权交易立法协调机制,对碳配额“适区”分配,跨区交易,集中监管,联动执法,为我国在“十三五”期间建成全国性碳排放权交易市场的立法体系提供理论支持。
At the APEC meeting in Beijing in 2014, China plans to set a maximum carbon emission limit by 2030. To this end China will gradually expand its carbon trading market and conduct trans-regional carbon trading. However, due to the lack of national legislation on carbon trading and the large differences in local legislation, the cross-border carbon trading market is in disorder. On the basis of drawing lessons from the more mature legislation of the EU and the United States on the legislation of the regional carbon emission trading, through the establishment of a cross-regional legislation mechanism for the coordination of carbon emissions trading, the allocation of carbon quota, “suitable area”, cross-border transactions, centralized regulation and linkage Law enforcement, to provide theoretical support for our country to establish a national carbon emissions trading market during the “13th Five-Year Plan.”
