农民土地股份合作社是在不改变我国农村土地所有权集体所有制度前提下的一种产权制度创新,论述了该制度与农业规模经营、农民集体土地入市、集体财产量化和农村城镇化等关系后,分析了该制度在法律上和实践中表现出的农民土地股份合作社的法律地位模糊、治理结构的异化、股权设置和实现困难等局限性以及对农民土地利益的影响。因此,差异化的利用农民土地股份合作社更能实现土地功能,同时借助农民土地股份合作社,通过完善立法能实现农村集体土地利益由国家向农村集体的让渡,并最终实现农民个体利益。
Farmers ’Land Stock Cooperatives is a property system innovation under the premise of not changing the collective ownership system of rural land ownership in our country. After discussing the relationship between the system and agricultural scale management, collective farmers’ collective land acquisition, collective property quantification and rural urbanization, The legal status of peasants ’land joint-stock cooperatives which the system shows in law and practice is ambiguous, the alienation of the governance structure, the limitations of the establishment and realization of the equity, and the impact on peasants’ land interests. Therefore, the differentiated use of peasant land shares cooperatives to better realize the function of land, at the same time with the peasant land stock cooperatives, through the improvement of legislation can realize the transfer of rural collective land interests from the state to rural collective transfer, and ultimately realize the individual interests of peasants.
