中国古代的证据制度以重视口供以及与此相关的刑讯逼供为其突出特征,其中刑讯逼供历经战国时期的发展至秦朝成为一种制度化的断狱手段,这与法家思想的理论支持是密切相关的,尤其是法家“好利恶害”的人性论和“重刑”主义思想为刑讯的发展提供了哲学基础和理论支撑。本文拟就此问题进行简要的论述。
