中国现有186.5万的保险营销员,这些人员在整个保险行业中是一个最特殊的群体。他们大多数与保险公司签订的是代理合同,而不是劳动合同,其收入来源主要是收取保险人的代理手续费,但享受不到公司给予正式员工的劳动报酬与社会保障,使他们陷入了一种“卖保险的没保险”的困境。由于他们的特殊身份,在法律监管上也容易出现漏洞,近年来也经常出现保险营销员为追求高额利润骗保的案例。2006年7月1日起施行的《保险营销员管理规定》是保监会首次针对保险营销员实施的管理办法,从资格准入、展业行为、保险公司的管理责任等方面实行了动态的法律监管,明确了保险营销员的法律地位,有利于保险市场公平有序的运转。
