从2004年夏天开始,本文作者先后七次提起带有公益性质的诉讼,其中三次针对铁路售货、用餐、退票费拒开发票,两次针对税务机关拒不履行“查处不开发票”的法定职责,两次针对地铁花费75亿元纳税人的钱却不设计公厕及收费不开发票。这些案件直接导致的结果是,北京地铁复八线从无到有,在所有的收费厕所配齐了五角的发票,并被西城地税局追缴偷漏税款两万余元;铁道部连续下发通知,要求全国各铁路局必须在火车上向旅客开具发票,依法缴纳税金。2006年2月,国家税务总局与铁道部联合下发文件,从3月1日起在全国的火车上配备统一印制的餐车发票。
