在祛魅的世界观背景下,现代实证法以一种有别于单纯制定法的决绝姿态登上了历史舞台,实证法的出现一开始就隐伏了极大的正当性危机。作为实证法而存在的法律无法找到一种“高级法”来为其提供正当性,意志性的实证法可能流于恣意,法治也有可能变成暴政。在此种形势面前,历史法学不满古典自然法提供的危机解决方案,提出了自己的法之民族精神正当性理论,试图用居于实在与玄妙之间的民族精神遏制实证法的恣意。
Against the background of disenchanted world outlook, modern positivism boarded the stage of history with a kind of determination that is different from simple formulation law. The emergence of positive law concealed a great crisis of legitimacy from the very beginning. The laws that exist as positive law can not find a “superior law” to provide legitimacy to them. The positivist positivism may flow in arbitrary ways, and the rule of law may turn into tyranny. In this situation, historical jurisprudence is dissatisfied with the crisis solution provided by classical natural law and put forward its own law of national spiritual legitimacy, attempting to contain the willfulness of positivism by the national spirit living between reality and mystery.
