在我国公务员行政追偿制度中，公务员的赔偿责任的主体身份是属于内部行政主体；在行政追偿中的公务员的赔偿 责任是财产责任、行政法责任、严格过错责任和行政连带责任。行政追偿中责任主体身份及责任性质的认定对我国行政追偿的立法完善及赔偿法律关系主体的利益平衡大有裨益。
In the system of civil servants’ administrative compensation in our country, the main body of civil servants’ compensation liability belongs to the internal administrative body. The civil servants’ compensation liability in administrative recourse is property liability, administrative law responsibility, strict fault liability and administrative joint and several liability. The identification of the main body of responsibility and the nature of the responsibility in administrative recovery is of great benefit to the improvement of the legislation of administrative recovery in our country and the compensation of the interests of the main body of the legal relationship.
