引渡是国际刑事司法合作的一种主要方式,包括主权国家之间的引渡和主权国家向国际刑事法庭(法院)进行的引渡。对请求国和被请求国主权的尊重是引渡得以进行的基本前提,离开主权原则,引渡无从谈起。同时,对引渡中相关当事人的人权保护是国际法的重要内容,体现着现代的法律精神。在引渡实践中,主权原则与人权保护往往存在冲突,这种冲突若得不到很好的协调,会导致引渡无法进行。本文区分两种引渡情况,对引渡中主权与人权的冲突与协调问题作粗浅探讨。
Extradition is a major form of international cooperation in criminal justice, including extradition between sovereign States and extradition by sovereign States to the International Criminal Court (the Court). Respect for the sovereignty of the requesting and requested States is a basic prerequisite for the extradition to be carried out. Without principle of sovereignty, extradition can not be done. At the same time, the protection of human rights of the parties involved in extradition is an important part of international law and embodies the modern legal spirit. In the practice of extradition, conflicts often exist between the principle of sovereignty and the protection of human rights. If such conflicts are not well coordinated, extradition will not be conducted. This article distinguishes between two types of extradition and provides a brief discussion on the conflicts and coordination between sovereignty and human rights in extradition.
