人体器官移植技术是20世纪现代生物医学发展的一个代表性领域,为末期脏器疾病的病患恢复健康带来了希望。但寻找器官供体一直是该领域中最大的难题,面临着很多法律问题。活体器官捐赠在器官来源中占有重要地位,其质量也较优。但从活体上获取器官也将涉及一些法律问题,主要有两点:一是活体捐献的供体身份问题,包括未成年人能否捐献器官,以及活体捐献的供体和受体是否一定要是亲属或夫妻关系;二是活体器官供体的风险及补偿问题。
Human organ transplantation is a representative field in the development of modern biomedicine in the 20th century. It offers hope for the recovery of patients with end organ disease. However, looking for organ donors has always been the biggest challenge in the field and faces many legal issues. Living organ donation plays an important role in organ source and its quality is better. However, there are two legal issues involved in obtaining organs from living bodies. There are two main issues: First, the identity of donors for living donations, including whether or not minors can donate organs, and whether donors and recipients of living donations must be relatives Or the relationship between husband and wife; second is the risk of organ donors and compensation issues.
