命令控制型环境规制的微调手段包含自上而下的行政动议、自下而上的适应性执行及契约式的灵活机制三个方面,有助于改善传统“一刀切”规制理念背景下的体系僵化、不协调及低效。然而,微调手段只是对命令控制型规制失灵的缓和而非革命性的替代。通过引入量化及风险权衡理论、民主主义理论、法解释中的行政裁量理论和不完全契约理论等进一步剖析微调手段应有意蕴,将能极大程度地发据其规制理性,并以现实拷问的视角直击命令控制型环境规制的痛点,无疑是我国环境问题的治理的一剂良方。
