近年来消费者权益维护现状发生了一些改变,维权案件多样化、诉讼成本过高、消费者诉讼公益性质增强等现状都呼唤着公益诉讼制度在该领域的建立。本文旨在探讨如何构建合理的消费者公益诉讼机制,并就扩大原告主体资格范围,设置诉讼前置程序,建立奖惩机制等方面提出了一些建议。
In recent years, some changes have taken place in safeguarding the rights and interests of consumers. The status quo of diversification of rights protection cases, excessive litigation costs and the enhancement of public interest in consumer litigation all call for the establishment of public interest litigation system in this field. The purpose of this paper is to explore how to construct a reasonable mechanism of consumer litigation, and put forward some suggestions on expanding the scope of the eligibility of the plaintiff, setting up pre-litigation procedures and establishing rewards and punishments.
