商品房预售制度在我国发展至今20年有余,为房地产行业发展和繁荣做出了巨大贡献。预售制度在促进我国房地产行业发展过程中发挥充分的积极作用,它加速了整个建设资金周转,提高了资金使用效率,扩大了企业开发能力。本文旨在从分析现有商品房预售行政监管相关法律制度的基本内涵和特点出发,比较现有行政监管制度的不足,找出我国商品房预售行政监管法律制度存在的主要问题及相应的处罚措施。
Commercial housing pre-sale system in our country more than 20 years of development, for the real estate industry has made tremendous contributions to the development and prosperity. Pre-sale system in promoting the development of China’s real estate industry to play a full and positive role in accelerating the entire construction funds turnover, improve the efficiency of the use of funds, expanding the capacity of enterprise development. The purpose of this paper is to analyze the basic connotation and characteristics of the relevant legal system of the pre-sale of administrative supervision of existing commercial buildings, compare the shortcomings of the existing administrative supervision system, find out the main problems existing in the legal system of pre-sale of commercial buildings and the corresponding penalties .
