2016年6月3日,国务院办公厅印发《关于加快培育和发展住房租赁市场的若干意见》(下称《意见》)。《意见》第12条关于“商业用房可改为租赁住房”的中央意见被视为住房租赁市场的重大政策利好,更被视作商业地产的“去库存”新政。2010年之后,中央出台了一系列调控政策,但大多是对城镇的住房价格进行调控,而忽视了商业地产的问题。在楼市“去库存”的大环境下,房地产库存结构性问题逐渐凸显,相比于住宅市场所面临的高库存问题,我国商业地产的库存状况更令人堪忧。本文从经济法视角出发,探讨当下我国房地产市场现状,对房地产宏观调控新政提出辩证性思考,针对宏观调控政策提出看法。
On June 3, 2016, the General Office of the State Council issued “Opinions on Accelerating the Cultivation and Development of the Housing Leasing Market” (the “Opinions”). The “Opinions” Article 12 on the “commercial premises can be converted to rental housing,” the central opinion is considered a major policy of the housing rental market positive, but also be regarded as commercial real estate “inventory ” new deal. After 2010, the central government issued a series of regulatory policies, but most of them are regulating the housing prices in urban areas, neglecting commercial real estate issues. In the property market “to stock ” environment, the structural problems of real estate inventory gradually highlighted, compared to the high inventory problems facing the residential market, the inventory of commercial real estate in China is even more worrying. This article from the perspective of economic law to explore the current situation of China’s real estate market, the real estate macro-control of the new policy put forward dialectical thinking, in view of macro-control policies.
