因大学自曝“欠巨债”向全校师生征集解决方案,引发了大家对高校破产问题的众多讨论。本文认为破产程序仅适用于企业法人,高等教育是由政府来主导创办的,高校是一个公共事业单位,因此高校没有破产能力,高校不能破产。但是高校的债务问题不应由政府来负全责,应由高校、地方政府、银行三方共同承担。文中指出高校可以采取政府贷款,扩大招收外国留学生,发行债券,利用科研专利筹措办学经费,制度化和规范化募捐等方法解决高校的债务危机问题
Due to university self-criticism “owed huge debt ” to the school teachers and students soliciting solutions, led to numerous discussions on the bankruptcy of colleges and universities. This paper argues that the bankruptcy procedure is only applicable to corporate juridical persons, that higher education is led by the government, and that the university is a public utility. Therefore, colleges and universities are not bankruptcy and universities can not go bankrupt. However, the debt problems of universities should not be taken full responsibility of the government, which should be shared by universities, local governments and banks. The article points out that colleges and universities can solve the debt crisis of colleges and universities by adopting government loans, enlarging and recruiting foreign students, issuing bonds, using research patents to raise running expenses, institutionalizing and standardizing fundraising
