随着我国社会主义市场经济的建立与不断发展,《企业法》与《公司法》根据形势需要应运而生。但是,在实际中,企业与公司运用形式众多,然而在理论层面上对企业法与公司法之间关系的分析与探讨仍然不够,因而在一定程度上妨碍了企业法与公司法作用的进一步发挥。所以,我们有必要对两者的关系进行理论上的研究与探讨。 With the establishment and continuous development of China’s socialist market economy, the “Enterprise Law” and the “Company Law” have come into being according to the needs of the situation. However, in practice, there are many forms of business and company use. However, the theoretical analysis and discussion of the relationship between corporate law and company law are still not enough, which hinders the further development of the role of corporate law and corporate law to a certain extent . Therefore, we need to make a theoretical study and discussion on the relationship between the two.
