美国国会2012年10月8日发布报告,称华为、中兴为中国情报部门提供干预美国通信网络的机会,对美国的国家安全构成潜在威胁,因而建议CFIUS对华为、中兴在美投资活动保持警惕。纵观美国对外资的国家安全审查制度,不管是最初的《埃克森——弗罗里奥修正案》,还是之后的《伯德修正案》,亦或者现行的《2007年外资与国家安全法案》,无不显示出国会对外资活动的政治监督。华为、中兴正是因为这一审查的政治性而受阻。
The U.S. Congress released a report on October 8, 2012, stating that Huawei and ZTE are providing China’s intelligence services with opportunities to intervene in the U.S. communications network and pose a potential threat to the national security of the United States. CFIUS therefore recommends that CFIUS be wary of Huawei and ZTE’s investment activities in the United States. Looking at the U.S. national security review system on foreign investment, whether it is the original Exxon-Florio Amendment or the Byrd Amendment, or the current 2007 Foreign Capital and National Security Act ", all show the political supervision of foreign capital activities. Huawei, ZTE was blocked because of the political nature of this review.
