我国法律将不动产善意取得制度予以明确,这无疑是我国立法上的重大突破,对于保障交易安全促进经济发展有重要意义。目前我国社会经济处于转型时期,各项制度尚未健全。不动产的善意取得制度的实施之中,问题层出不穷,特别是与不动产登记制度有关的案例尤为显著。文章分析不动产善意取得制度的理论依据和价值评析、构成要件、适用范围,找出存在问题并提出解决方案与合理建议,以期完善我国不动产善意取得制度。
It is undoubtedly a major breakthrough in our country’s legislation that the law of our country should make clear the bona fide acquisition of real estate, which is of great significance for ensuring the safety of transactions and promoting economic development. At present, China’s social economy is in a period of transition, and various systems have not yet been perfected. In the implementation of the system of goodwill acquisition of real property, problems are emerging in an endless stream, especially the real estate registration system. This article analyzes the theory basis and value evaluation, constitutional requirements and applicable scope of real estate bona fide acquisition system, finds existing problems and puts forward solutions and reasonable suggestions in order to improve the bona fide acquisition system of real estate in our country.
