法律制度作为在特定的社会历史环境下生成的规范体系,它不仅要在致力于解决现实社会秩序的种种矛盾中经受考验,而且,要在回应社会变革所提出的挑战中发展与变革。纵观劳动教养制度的研究与现实,存在众多的矛盾冲突与理论困惑。由于对决定这一制度命运的根本性问题:如思想基础、价值取向、正当性与合理性等问题,缺乏深入、系统的研究,更少见具有建构意义的理性批判与反思,这种状况成为劳动教养立法屡屡受挫、制度创新举步维艰、长期处于徘徊局面的深刻原因。因此,研究劳动教养制度的内在机理、功能和作用,对其在现实社会的法治建构中的价值定位,从哲理、法理和社会文化等方面作必要的梳理,在此基础上,进一步确立现行制度变革的法理基础与立法构想。
