预告登记制度对应于本登记,是为补充不动产登记的公信力的缺陷而设立的一种制度。我国目前在商品房预售领域主要实行预售商品房合同登记备案制度,这一制度属于行政管理,存在诸多不完善之处。为保护商品房预购人的合法权益,应建立预告登记制度。我国应在借鉴国外以及台海地区经验的基础上,选择适用于本国国情的制度设计,建立完善的商品房预告登记制度。
The advance notice registration system corresponds to this registration and is a system set up to supplement the shortcomings of the credibility of real property registration. At present, China mainly implements the system of registration and filing of contracts for the pre-sale of commercial houses in the pre-sale of commercial houses. This system belongs to the administration and there are many imperfections. In order to protect the legitimate rights and interests of pre-purchasers of commercial housing, a notice registration system should be established. Based on the experience of other countries and the Taiwan Strait, our country should select the system design that is suitable for its own national conditions and establish a sound pre-registration system for commercial housing.
