中介业务是中国实行改革开放政策后恢复其法律地位并在上世纪末较快发展起来的行业。由于现有的法律、法规尚不够完善,使得中介经纪行业成为产生社会矛盾和纠纷较多的一个经济领域。房地产中介行业同样有这些现象存在。从现实经济生活看,房地产中介活动常见的纠纷有交易行为与中介行为混淆造成的合同纠纷、中介机构超越委托人的授权服务权限造成的纠纷、中介合同的条款欠缺造成的纠纷、中介服务标准与收取佣金标准差异造成的纠纷等。
