为给互联网这一新兴技术创造一个较为宽松的制度空间,在现今各国的相关立法中均不约而同地采纳了“避风港”规则,从而使网络服务提供者获得与侵权责任进行彻底切割的机会,并较好的平衡了网络服务提供者与受害人之间的利益关系。但是,WEB2.0时代的到来打破了原有法律制度中所小心维系的权利义务平衡状态,给传统“避风港”规则提出了新的挑战。本文将以WEB2.0时技术为背景对传统“避风港”规则所面临的挑战进行分析,并试图通过建立披露规则,重新恢复网络侵权行为中各方当事人之间的利益平衡状态。
