在中国漫长的历史中,历代统治者通过不断地实践总结出了一套礼法结合的治理体系。礼的原则一直是中国封建社会中国家的统治秩序的根据,而封建社会法律实践活动及其成果也逐渐总结升华形成了独特的法律文化。但现代法治的维持力量与传统礼治不同,须依靠国家的权力来维持,是一种强迫实施的统治秩序。因此本文认为要形成“依法而治”的现代社会仍需要制度上的健全,同样迫切的是改变人们的传统“无讼”思想,确立法制意识。
In the long history of China, the rulers of various dynasties summed up a system of governance combining law and court through continuous practice. The principle of etiquette has always been the basis of the ruling order of the Chinese feudal society, and the legal practice of feudal society and its achievements are gradually summarized and sublimated to form a unique legal culture. However, the maintenance of modern law and ruling power is different from the traditional rituals and depends on the power of the state to maintain. It is a forcible implementation of the ruling order. Therefore, this paper argues that the modern society that is going to form a “governing according to law” still needs institutional soundness. It is equally urgent to change people’s traditional “non-lawsuit” thinking and establish the awareness of the legal system.
