我国自1995年实行初任检察官考试制度以来,至今已举行了四次。但随着时代的进步,各种科学知识的日新月异,检察官队伍无疑又面临着新的挑战,而作为选拔优秀人才的初任检察官考试制度则首当其冲。为此,笔者依当前检察队伍建设现状及发展趋势,就初任检察官考试制度需完善的几个问题提出一点建议。 一是应把新调任各级检察院任检察长、副检察长和检委会委员(如纪检组长)的干部纳入全国初任检察官考试的范围。因为现实中,特别是在基层,这些新调任的干部大都来自检察机关以外的其它党政机关及企事业单位;他们的法律知识多寡不一、水平不均,而检察工作是一项极其专业化的工作,非具有深厚的法律素养是难以胜任的。因此,将他们纳入初任检察官考试范围,择优去劣,是检察事业百年大计之所需,也符合《检察官法》立法之精神。
My country has held four examinations since it started the examination system for first-time prosecutors in 1995. However, with the progress of the times and the ever-changing scientific knowledge, the ranks of prosecutors undoubtedly face new challenges. As the first-time prosecutor exam system for selecting outstanding talents, they are the first to bear the brunt. Therefore, based on the current situation and development trend of the construction of procuratorial teams, the author puts forward some suggestions on several issues that should be perfected for the examination system of new prosecutors. First, new proclamations should be transferred to Procuratorates at all levels as Procurator-General, Deputy Attorney General and members of the Procuratorate (such as discipline inspection team leader) cadres into the national prosecutors examinations range. Because in reality, especially at the grass-roots level, most of these newly re-established cadres come from other party and government organs and enterprises and public institutions outside the procuratorial organs. Their legal knowledge is mixed and uneven, and procuratorial work is extremely specialized Of the work, not with the profound legal literacy is not competent. Therefore, incorporating them into the scope of the examinations for first-time prosecutors, selecting the best and the worst, is required by the centenary of procuratorial work and in the spirit of legislation of the “Prosecutor’s Law.”
