1931年《中华民国民法》及相关司法解释取消妾相对于妻的仆从地位、降低娶妻的仪式要求,使得原来泾渭分明的妻、妾、姘妇界限变得模糊难辩。法律的重大变化反应于普罗大众生活当中的情况,可以从当时广州销量最大的《越华报》相关案件报道中进行观察与分析。有别于过去的妻妾身份争议及其控辩策略揭示出从法律文本到通俗案例文本,法律精英“提升女权”的理想越来越被弱化处理的历史事实。
In 1931, the Republic of China Civil Law and related judicial interpretations abolished the position of servant of concubines relative to wives and lowered the requirement of rituals of wives, making the original boundaries of wives, concubines and women ineffectively blurred. Major changes in the law reflect the general public’s life situation can be observed and analyzed from the case reports of the largest sales in Guangzhou at that time. Different from the past controversy over wives and concubines and their prosecution and defense strategies, the historical facts from the legal texts to popular case texts and the legal elite ’s “promotion of women ’ s rights” are being weakened more and more.
