二十世纪五十年代末,发展中国家为了快速在经济上崛起,常常通过吸引外资的形式谋求国际性的合作,将外国的先进技术与大量闲置资金引进到本国,一方面解决国内技术落后,另一方面也解决了资金不足的问题。发展中国家盲目制定优惠的投资政策与法律环境,近乎于取悦外国投资者来本国投资,进而大量签订各种国际投资条约,然而东道国却没有足够的警惕在给予外国投资者这些优惠的同时将会存在怎样的风险。本文将阐述“保护伞条款”所引发的风险,并提出相应的对策。
